I think she is taking this one over the top because it is from the UK and other stories such as ones involving CCTV have made her paranoid about UK government intervention (perhaps rightly so, but in this case not so much). Really this is just a case of public disturbance, whatever is causing the noise is really irrelevant, they aren't trying to control their sex life they're trying to control the noise.

Also I'd like to note that Cenk got it completely wrong on the noise level. Decibels are not a linear measurement every increase of 3dB corresponds to a doubling in noise level. So as someone pointed out earlier 40dB is a refrigerator hum so it is a little over 4 times louder than this.
