Though I think asking a judge to rule in this case is silly (most disagreements between neighbors can be settled in other ways like mediation, etc.) I have to say that I think both parties need to come to a compromise. Some people are picky about noise at night and they can rarely be satisfied with close, noisy neighbors, but I find it hard to believe the couple couldn't tone it down some. Being vocal myself, I have found ways to not bother neighbors at night. The same goes for more "vocal" roommates. We all believe in the power of good earplugs. Not to mention, my apartment is right next to the freeway so I have to deal with 24 hour noises, but I don't complain. I just put in some earplugs or headphones. I was also wondering how the neighbor heard this noise? Did they share a wall, like in an apt or a twin home or duplex?
To wrap this up, I think both parties are guilty of some disrespect but government has NO place in this conversation.

Those people aren't "banned from having loud sex". They were banned from making noise in the night, while their neighbors are trying to sleep. Ana understood it like the government was telling them "how to have sex". That's just not true.
They can still have loud sex where nobody is disturbed by it. In the car, in the forest, in the dunes... Or they can have loud sex at daytime, maybe saturday afternoon. Or they can have more "silent" sex at night. It's just that they can't go ballistic, at home, at night, just like they can't play the trumpet or mow the lawn at night. The big bad government doesn't allow that either. Does that mean they're telling them which kind of instrument to play, or what their garden should look like? No, they're only protecting the bounds of reason.
