First:  obviously I agree with you that Conservatives have no basis for 70% of their constant lunatic allegations about Obama (and the other 30% is proudly touted by Obama--it just doesn't suit the Conservative ideology, so they scream it out as though it is an epithet when it is actually part of Obama's unashamed agenda or personal makeup).  If the conspiratorial allegations by the Right were actually discussed in trial, it would be laughably frivolous and even money suggests that the Right would probably perjure itself several times.

  The problem is that the Right is not interested in the truth--only the allegations and their political PR.  The out-of-touch paranoid uneducated masochists who still identify with the mainstream Conservative movement have 100000% made up their mind as far as the criminality/treachery/gener al worthlessness and evil of Obama and all Liberalism.  For the 77% of the country who rationally sees Obama as either doing a good or mediocre or bad job but not as a terrorist sleeper cell or the anti-Christ or a Kenyan slave-master or Chairman Mao, this trial would point out what we already know--that the Right wing is insane, destructive and appallingly blind to their own hypocrisy and ignorance.

  But, while this trial would thus offer nothing to the collective rational-mind argument about Obama or the poisonous Right, to the 23% of people who will tell their children and grandchildren about the evil scourge of every political and cultural figure to the Left of Duncan Hunter, this would bring immense legitimacy to their drivel.  "Obama is the first president ever brought on trial for being anti-American!  The country has decided that Obama needs to defend his heinous practice of taking control of our country!  How are ACORN and the Liberal media and the activist judiciary and Emanuel's Chicago thug parade going to weasel Obama out of admitting to his crimes and telling us why he wants all of us to wear burkas?"  The Right would get an orgasmic high out of this exercise, fabricating conclusions out of any "ambiguous" answers and outright lying about the merits of the arguments.  For years to come, this would allow every Right wing pundit to proudly tout the fact that they had a hand in seeing Obama and his people squirm in a witness chair (even if they were not squirming).  This would absolve every last drop of blame for Bush on any issue ("if Democrats felt so strongly that Bush was committing war crimes/hurting the country with his negligence/caught in deliberate lies about Iraq/generally too incompetent to continue serving as president, why didn't they move to put him on trial?  Clinton = impeached, Obama = sued for impeachment, thank God Bush was squeaky clean").  It could provide an overarching rallying cry for a movement otherwise in spectacular dissarray.  It would encourage (as though such a thing needs a further reason) every crazy, dangerous conspiracy theorist to spout their views on TV (and not just FOX) as part of a legitimately huge ongoing news story.   It would waste months of the government and Obama's time (exactly what the Right wants--delay and distraction on every issue for as long as possible until they can "regain power" in 2010).  Any decision to throw out the case on any level (by reason of insufficient cause) would be seen as a vast coverup and spark a new series of conspiratorial theories and hatred of the government.  Obama's approval rating would almost surely drop--there is no way that anyone looks better after being the defendant of a smear trial (unless they are coming from a position of being loathed to being less so, which does not apply with Obama), but there is every chance that some piece of information would emerge to make him look a lot worse (even if, in context, such an item is relatively harmless before it is fed through a month of Right wing blog-o-chamber spin)

  And, ultimately, do you seriously think that, when Obama was found not guilty of this litany of craziness, the Right would drop their allegations?  Stop believing that they were true?  Give Obama a break on the way he is leading the country?  Cede the floor to a rational discussion of Obama's merit, having had their propaganda officially rebuffed in a court room?  Again--this is a party of sore losers, terrified maniacs and (to borrow a Rush Limbaugh term) poisonous snakes.  They will NEVER give Obama legitimacy, they will NEVER stop accusing him of the worst crimes against America, and they will NEVER be satisfied with a trial (or any other contest) that does not go their way.  Philip Berg brought his "Obama birth certificate" case as high as it could go through the justice system.   There was a huge push to get the case heard by the SCOTUS, but ultimately it came to nothing.  There was no story to begin with.  How many Conservatives, upon seeing the case litigated to its full extent in court, are satisfied with the belief that Obama must thus be an American citizen?  The court case just riled them up more, drew unwarranted publicity to such a ridiculous and thoroughly-debunked charge, and the verdict was dismissed in Conservatives' minds as a lie or as corruption.  Imagine that case x 1000, as it would provide hours and hours of show trial posturing for Conservative presidential hopefuls and Congressmen/pundits trying to make names for themselves by being the most outrageous in their epithets (as though there is anything more extreme to call Obama than what he is already being called).

  We had a "trial" of sorts on Obama's political views, associates, resume, etc.  We have another one in November of 2012.  If the Right want Obama banished from the kingdom for his misdeeds and alleged anti-American leanings, they have a chance to do so at the ballot box.  Yes, I know Bush was elected twice (sort of) and now we still want him to face trial for a number of things.  But at least there is substantial, basically-undisputed evidence toward such a matter.
